Welcome to OZANA. These Terms and Conditions govern access to and use of this website, as well as purchases of products offered by OZANA. By using the website or placing an order, you accept these conditions, subject to the rights granted to you under applicable consumer-protection laws.
1. Merchant contact information
OZANA’s current official contact information is available on our Contact page. For any request, clearly identify the product or order number concerned.
2. Use of the website
You agree to use the website only for lawful purposes. In particular, you must not:
- attempt to access OZANA systems without authorization;
- disrupt the operation or security of the website;
- use the website for fraudulent purposes;
- reproduce or exploit website content without authorization;
- transmit malicious code or any technology likely to damage the website.
OZANA may take the measures reasonably necessary to protect its website, users and systems.
3. Product information
OZANA makes reasonable efforts to ensure that the descriptions, photographs, dimensions, specifications and information presented on the website are accurate.
Minor differences may nevertheless exist between photographs or renderings and the physical product, particularly because of colour display, production changes or the digital presentation of products.
When a feature is essential to your purchase, consult the technical sheet for the product concerned. Rights provided by law regarding a product’s conformity with its description remain fully applicable.
4. Filtration technologies and performance
The performance of a filtration system can vary according to several factors, including:
- incoming water quality and the concentration of substances present;
- pressure, temperature and flow rate;
- installation and maintenance;
- the condition and period of use of filters or membranes.
Terms such as “filtration,” “reverse osmosis,” “ultrafiltration,” “reduction,” “purification” or “UV treatment” describe product technologies or functions. They must not be interpreted as a guarantee that every contaminant will be removed.
Specific reduction percentages or claims applicable to a product are those supported by the tests or certifications for the product or component concerned and under the conditions of those tests. Consult our Warnings page before using an OZANA product.
5. Drinking water and product use
Unless expressly stated otherwise for a system designed for a specific water source, OZANA drinking-water systems must be used with a potable municipal water supply or a source whose quality has been verified.
A residential system must not be used as the sole method of making microbiologically unsafe water, or water of unknown quality, safe to drink without appropriate treatment and testing.
Products must be installed, used and maintained in accordance with the instructions provided.
6. Prices
All prices displayed on our website are in Canadian dollars (CAD), unless otherwise stated. Taxes, delivery charges and other applicable fees are shown before the order is confirmed. The total amount payable is presented to the customer before the transaction is completed.
7. Orders
Before confirming an order, you can review the products selected, quantities, your contact information, delivery address and total amount. Once the transaction is completed, a confirmation is sent electronically. We recommend keeping it.
Product availability may vary. If a problem occurs after an order has been completed, OZANA will contact the customer and address the situation in accordance with applicable laws.
8. Payment
Accepted payment methods are those displayed at checkout. Payment must be authorized before the order is processed. By completing a transaction, you confirm that you are authorized to use the payment method provided.
OZANA may use external service providers to process payments and prevent fraudulent transactions.
9. Delivery
Applicable delivery options, charges and estimated timelines are presented during checkout or in information displayed on the website. Timelines identified as estimates are estimates. The customer must provide a complete and accurate address.
When mandatory rules for distance contracts provide remedies for delay or failure to deliver, those rights remain applicable.
10. Receiving your parcel
We recommend inspecting your order as soon as it is received. If a product is damaged, defective, incomplete or different from the product ordered, contact customer service as soon as possible and include your order number and photographs where relevant.
This procedure does not limit any right you may have under the law.
11. Returns, exchanges and refunds
Returns, exchanges and refunds are governed by the applicable policy published on the website. That policy forms part of the conditions applicable to your purchase. Nothing limits mandatory rights under Quebec’s Consumer Protection Act or any other applicable law.
12. Installation
Certain OZANA products require installation or connection to a plumbing system. The customer must follow the instructions provided and ensure that the installation complies with applicable codes and requirements.
When the nature of the product, local regulations or installation characteristics require it, a qualified professional may be necessary. OZANA is not responsible for damage directly attributable to an installation that does not follow the instructions, subject to rights and remedies provided by law.
13. Maintenance and filter replacement
Filtration systems require periodic maintenance. Cartridges, membranes, UV lamps and other consumable components must be replaced according to the recommendations applicable to the product.
The actual life of a filter or membrane can vary with water consumption, incoming water quality, contaminant concentration, flow rate and operating conditions. Use beyond the recommended interval can reduce performance.
14. Parts, consumables and service
Information about cartridges, membranes, replacement parts, consumables and services required for maintenance is provided on the relevant website pages or can be obtained from customer service.
When the law requires this information to be disclosed before purchase, OZANA provides it in accordance with applicable requirements.
15. OZANA warranties
When a specific conventional warranty is offered with a product, its term, scope and conditions are stated in the documentation accompanying the product or on the corresponding website page. This warranty is in addition to warranties provided by law and does not replace them.
16. Legal warranties in Quebec
For Quebec consumers, products sold by OZANA benefit from legal warranties provided in particular by the Consumer Protection Act and the Civil Code of Québec. These warranties may require that a product:
- be fit for the purpose for which it is normally intended;
- be durable in normal use for a reasonable length of time, having regard in particular to its price and conditions of use;
- conform to its description;
- be free of latent defects in the circumstances provided by law.
Nothing in these Terms and Conditions is intended to exclude, restrict or replace a warranty or right that cannot be waived.
17. Limitation of liability
To the extent permitted by law, OZANA is not liable for damage directly resulting from use contrary to the instructions, use with incompatible components, an unauthorized modification, clearly inadequate maintenance or conditions for which the product was not designed.
This limitation does not apply where prohibited by applicable law and does not reduce a consumer’s legal rights.
18. Intellectual property
Unless otherwise stated, all content on the website belongs to OZANA or is used with authorization, including the OZANA name, logos, visual identities, photographs, 3D renderings, videos, illustrations, text, graphics, icons, website design and proprietary technical documents.
This content is protected by applicable laws. Reproduction, modification, distribution, sale or commercial exploitation is not permitted without prior written consent, except where the law allows it.
19. Third-party marks and certifications
Marks, logos, standards and certifications belonging to third-party organizations or businesses remain the property of their respective owners. When a certification applies only to a component, it does not mean that the complete system holds the same certification. Its exact scope is the one stated in the applicable documentation or registry.
20. Third-party websites and services
The website may contain links to, or integrate services operated by, third parties. OZANA does not control their content, availability or practices and is not responsible for their own terms or policies.
21. Personal information
The collection and processing of personal information related to website use and orders are governed by our Privacy Policy.
22. Changes to these terms
OZANA may change these Terms and Conditions to reflect changes to its services, practices or applicable laws. Changes do not retroactively affect rights arising from a transaction already completed, except where permitted by law.
For provisions that form part of the sales contract, the applicable version is the one presented to the customer at the time of the transaction.
23. Applicable law
These Terms and Conditions are governed by the laws applicable in Quebec and Canada. For a consumer, nothing limits the right to benefit from mandatory rules or to bring proceedings before a competent court in accordance with applicable laws.
